Adequate notice must meet all of the requirements set forth in 18 NYCRR § 358-2.2.

Aid to Families with Dependent Children (AFDC) was a program of cash assistance and services created by Title IV-A of the Social Security Act of 1935. See 42 U.S.C. former §§ 601-617 (1995). The AFDC program was repealed and replaced on August 21, 1996 by the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (P.L. 104-193), which created Block Grants for Temporary Assistance for Needy Families (TANF). See 42 U.S.C. §§ 601 et seq.

"Aid continuing means the right to have public assistance, medical assistance, food stamp benefits or services continued unchanged until the fair hearing decision is issued." 18 NYCRR § 358-2.5.

Administrative Law Judges (ALJs) are also known as Hearing Officers. "Hearing officer means an attorney assigned by OAH to preside at hearings." 18 NYCRR § 358-2.13.

Covered programs or services means one or more of the following: family assistance, safety net assistance, medical assistance, emergency assistance to aged, blind or disabled persons, emergency assistance to needy families with children, food stamps, HEAP, and any services funded through the New York State Department of Family Assistance as defined in section 358-2.20 of this Subpart. 18 NYCRR § 358-2.9.

When there is no material issue of fact to be resolved, a decision may be issued without a hearing. See 18 NYCRR § 358-6.2.

DOH refers to the New York State Department of Health.

"Fair hearing means a formal procedure provided by OAH upon a request made for an applicant or recipient to determine whether an action taken or failure to act by a social services agency was correct." 18 NYCRR § 358-2.12.

The Food Stamp program has been renamed the Supplemental Nutrition Assistance Program (SNAP). See 18 NYCRR § 387.0.

The Home Energy Assistance Program (HEAP) is "a State supervised program to assist eligible low-income households in meeting the costs of home energy," that is, "a source of heating in residential dwellings." 18 NYCRR § 393.1(a).

The New York State Department of Social Services (NYSDSS) was renamed in 1997 as the New York State Department of Family Assistance, within which were established two autonomous offices: the Office of Children and Family Services (OCFS) and the Office of Temporary and Disability Assistance (OTDA), each headed by a Commissioner, who together constitute an inter-office coordinating council. The Welfare Management System (WMS) is a statewide computer system which receives, maintains and processes information relating to persons who have applied for or been determined eligible for benefits under any of the programs for which OTDA has supervisory responsibilities under the Social Services Law.
